‘Providers cajoled into court battles’

Care providers are being wrongly encouraged to mount legal battles
against the care system, it is feared.

The National Care Standards Commission said a barrage of litigation
could detrimentally affect service users and care home
residents.

The NCSC said some providers had been advised to legally challenge
the regulatory system, citing the Human Rights Act 1998.

Heather Wing, the NCSC’s director of adult services, said the NCSC
needed to be talking to care providers, “not arguing with them
across a court room”.

“We are concerned that these commentators are offering flawed
advice,” she said.
