Wandsworth wins support test case

The parents of two severely disabled children who claimed they
received inadequate support from their local council have failed in
their Court of Appeal test case.

Michael and Henrietta Spinks were appealing against a decision that
Wandsworth Council in London had acted lawfully in refusing to
provide essential care equipment for their sons, aged 16 and
12.

Last week, three judges ruled that Wandsworth Council in south
London was entitled to inquire into the Spinks’ financial situation
in deciding whether to make arrangements to meet the boys’ needs.

Wandsworth social services director Peter West said it clarified
the law in this area for local authorities. “We must first have an
understanding of the parents’ ability to contribute to costs,” he
said.
