Scots set forth legislation on regulating care and housing issues

The regulation of social care is to play a major part in Scotland's legislative programme in the coming year according to the Scottish executive's agenda announced last week.

The Regulation of Care Bill is one of nine pieces of legislation planned. The main planks of the bill are the creation of the Scottish Social Services Council and the Scottish Commission for the Regulation of Care. The council will establish registers of particular groups of social work staff.

Residential care for adults and children, home care, day care, early education, childminders, housing support services, nursing agencies, adoption and fostering and independent health care will all fall under the powers of the Scottish Commission for the Regulation of Care.

The Scottish executive intends the SSSC to be operational from October 2001 and the commission by April 2002.

Housing issues

Meanwhile, a housing bill introducing a social tenancy that improves rights of succession by carers is among a raft of social care issues to be addressed in the first full legislative programme of the Scottish parliament.

A system of yellow and red cards before eventual eviction will be applied to allegations of anti-social tenancies. Homeless people are to be accorded new rights to temporary accommodation, advice and assistance.

Also a Human Rights Bill is being introduced to ensure all legislation is amended according to the terms of the European Convention.
