Poll shows confusion on capacity law

Most people mistakenly believe their partner has the legal right to be consulted about decisions on their behalf if they lose mental capacity, a new study has revealed.

Commissioned by the Making Decisions Alliance, a group of voluntary agencies, the NOPstudy reveals that 92 per cent of respondents believe their partner would be legally consulted if they were unable to make decisions. The alliance is urging the government to introduce a law to define mental capacity and to provide support to people without capacity to help them with decisions.
