Permission to appeal against the decision to close the Moreton Centre for older people in Hastings has been turned down.
Lord Justice Simon Brown said he found the judgement following the judicial review “entirely convincing”. An appeal would be damaging to the interests of all concerned, would have no realistic prospect of success, and would involve unjustifiable public expense, he added.
Keith Glazier, lead county council cabinet member for social services and health, said that the decision confirmed that the council acted correctly.
He added that day care will continue to be offered by the centre while respite care will be provided by the independent sector at a different location.
East Sussex council plans to redevelop the Moreton Centre to provide intermediate care.
