Three care home residents were due to submit an appeal this week against a High Court ruling that private care providers were not subject to human rights law.
They were due to appeal to the Court of Appeal after the rejection of their judicial review against Havering Council's decision to move them from in-house care homes into private care (Independent providers expected to face liability despite ruling on rights).
They had claimed this breached their human rights because case law exempts private providers from the Human Rights Act 1998. But the court ruled that the council would still be responsible for safeguarding their rights.
Campaigners seek a ruling that puts private providers under the act.
