Please help me!!!!! I am a second year social work student, I have a law assignment and can't get my head around this question.  The case study is set around the mother having schizophrenia and she is chanting in her underwear in the street.  From the case study it would suggest the children are on their own.  One child being 14 years and the other having down syndrome is 7 years old. 

My question is before a social worker can place a child into accomodation under section 20 CA, will they need to apply for an EPO to enter a property and remove the child from their existing property if they are considered to be at risk.

section 20 is voluntary accommodation - they need either the mother's permission (if capable of giving it) or the father if he has parental responsibility (either because he is or was married to the mother or this has been granted via a solicitor or court)

an EPO will be section 31 (care orders)

police can remove children under 'police protection' (note this is not an 'order') which lasts 72 hours while EPO is sought

otherwise yes, need EPO via a magistrate
