Owners win right to judicial review

Owners of six care and nursing homes have won the right to a full
judicial review of the rates paid by Birmingham Council.

The High Court agreed that they had an “arguable” claim that the
council was jeopardising the health of older and vulnerable
residents by refusing to cover the “true cost” of care. A hearing
is due on 9 October.

The homes have been joined in the action by nine people who say
they face being removed because the council will not pay the fees
or have been refused funding for places at the home of their
choice.

Birmingham denied it refused to place new residents in the homes,
but said it had refused to pay the fees being demanded.
